1. About this statement

Bjornsen Pond Management & Services LLC, doing business as Bjornsen Pond Management (“Bjornsen,” “we,” “us,” or “our”), respects your privacy.

This Cookie and Privacy Statement (US) explains how we collect, use, disclose, retain, and protect personal information when you visit our website, purchase products from our online store, create a customer account, request pond-management or fish-stocking services, submit information through our forms, or communicate with us. It also explains our use of cookies and similar technologies and the choices available to you.

This statement is a notice of our information practices. Visiting our website, submitting an inquiry, or placing an order does not, by itself, constitute consent to optional advertising cookies or enrollment in marketing communications.

2. Information we collect

Information you provide directly

We collect information you choose to provide when making a purchase, creating an account, requesting assistance, or communicating with us. Depending on your interaction, this includes your name, email address, telephone number, billing address, mailing address, shipping address, organization, account credentials, and the contents of your communications.

When you request pond-management services, fish stocking, recommendations, or an estimate, we collect the information you provide about your property and project. This can include the pond’s location, map descriptions, access or delivery directions, size, depth, water clarity, electrical service, management concerns, fish selections, and other details relevant to your request.

We also collect photographs, documents, and other materials you choose to submit. Please provide only information relevant to your request and avoid including sensitive information about yourself or other people that we do not need.

Purchase and account information

When you use our online store, we collect information needed to process and support your transaction. This includes the products you order, quantities, prices, discounts, taxes, delivery information, payment status, order history, and records of returns, refunds, or support requests.

When you create an account, we retain information needed to maintain it, including your contact details, addresses, account preferences, and associated order information.

Payment processing is described separately below.

Technical and website-use information

Our website and the services supporting it process technical information needed to deliver pages, maintain functionality, and protect the website. This can include your IP address, browser and device information, requested pages, access times, referring pages, and security or error logs.

Where optional analytics or advertising technologies are enabled in accordance with your choices, additional information can include pages and products viewed, campaign information, website interactions, online identifiers, and purchase or inquiry events.

We also process information needed to record and apply your privacy choices.

Information from service providers

We receive information from providers that help us learn more about pond owners and enthusiasts, complete transactions, and operate our business, such as payment confirmations, shipment updates, fraud-prevention results, and information for delivering communications.

3. How we use personal information

We use personal information to respond to questions, evaluate pond-management needs, recommend products and services, prepare estimates, coordinate fish stocking and deliveries, schedule work, and maintain appropriate customer-service records.

For online purchases, we use information to process payments, calculate shipping and taxes, fulfill orders, manage accounts, provide updates, and handle returns, refunds, warranties, or other support requests.

We also use information to operate and improve the website, prevent spam and fraud, investigate technical problems, protect our systems and customers, maintain business records, comply with legal obligations, and establish or defend legal claims.

Where permitted and subject to the choices described in this policy, we use information to understand website performance, evaluate marketing campaigns, and communicate about relevant products, services, and promotions.

Some information is necessary to complete a purchase or provide a requested service. Without it, we may be unable to fulfill that particular request.

4. Online store and payment processing

Our online store runs on WooCommerce.

Payments are processed through Intuit Payments Gateway and WooCommerce PayPal Payments. The provider used for your transaction receives information needed to process or support the payment. This can include billing and contact information, transaction details, and information used for authentication and fraud prevention. We receive information needed to confirm and administer the transaction, such as payment status and transaction references.

Payment providers also process information under their own privacy notices. Their notices are available through:
• PayPal
• Intuit

Your credit card account information is relayed to the appropriate payment processor and is NOT stored on Bjornsen Pond Management servers. Please do not send full payment card numbers, card security codes, passwords, or other sensitive credentials through our contact forms or ordinary email.

5. How we disclose information

We disclose personal information as needed for the purposes described in this policy.

Payment, shipping, and fulfillment providers. We disclose relevant contact, billing, transaction, delivery, and order information to providers that process payments, ship products, fulfill orders, or arrange requested services.

Analytics and advertising providers. Where enabled and subject to applicable choices, these providers receive the information described in the analytics and advertising section below.

Some recipients process information on our behalf. Others, including certain payment or advertising providers, may also process information for purposes described in their own privacy notices.

6. Analytics and advertising

We use Google Analytics and public data provided by data aggregation services to understand how visitors use our website and which pages, products, and campaigns lead to inquiries or purchases.

When applicable technologies are enabled, these providers receive data, which may include online identifiers, device information, page views, referral or campaign information, and transaction or conversion events.

You can manage optional analytics and advertising technologies through Cookie Settings. Additional privacy rights, where applicable, are described below.

Sale, sharing, and targeted advertising

Bjornsen Pond Management does not sell your information. Bjornsen Pond Management does participate in cross-context behavioral advertising or targeted advertising under applicable laws.

7. Email and other communications

We use your contact information to respond to inquiries and send communications related to orders, accounts, deliveries, appointments, and requested services.

When you subscribe to marketing communications, or where another lawful basis permits us to send them, we may send information about pond management, products, services, seasonal recommendations, events, and promotions.

Our email-marketing provider is MailChimp. Every email message that we send includes an unsubscribe link in the footer. Unsubscribing will remove you from our email marketing list. Opting out of marketing does not prevent us from sending necessary order, account, safety, or service communications.

Consent to optional website cookies is separate from consent to marketing messages. Providing a telephone number for an inquiry or delivery does not, by itself, enroll you in a promotional text-message program.

8. Cookies and similar technologies

Cookies are small files stored on your browser or device. Similar technologies can include local storage, pixels, and tags.

Some technologies are provided directly by our website. Others are provided by third parties. Some last only for a browsing session; others remain for a defined period or until deleted.

We organize these technologies by purpose.

Category Purpose

Strictly necessary: Supports essential functions such as shopping-cart operation, authentication, requested checkout functionality, security, and saving privacy choices.

Preferences and optional features: Remembers optional preferences or enables additional features that are not necessary for basic website operation.

Analytics: Helps us understand how the website is used, identify performance issues, and evaluate interactions with pages, products, and campaigns.

Advertising: Supports advertising measurement and any personalized advertising or remarketing described in this policy.

9. Managing cookie and tracking choices

Strictly necessary technologies remain active when needed to operate the website or provide a service you request.

Optional preference, analytics, and advertising technologies are not activated unless you select the corresponding options. You can accept all optional categories, reject nonessential technologies, or save individual category choices.

You can change or withdraw your choices at any time through Cookie Settings, available in our website footer.

Rejecting optional technologies does not prevent you from browsing our core content or making a purchase, although some optional features may be unavailable.

Preferences generally apply to the browser and device on which you make them. You may need to set preferences again when using a different browser or device, or after deleting stored preferences.

Withdrawing consent stops future activity that depends on that consent. It does not automatically delete previously collected information or records retained for another lawful purpose. You can contact us separately about deletion.

You can also manage cookies through your browser. Blocking all cookies may interfere with shopping-cart, login, or checkout functionality.

Browser privacy signals

We recognize legally required opt-out preference signals, such as Global Privacy Control, as requests to opt out of the sale or sharing of personal information or targeted advertising to the extent required by applicable law.

10. Photos, saved forms, and third-party content

Photographs and submitted materials

Photographs and other materials submitted for a pond-management or fish-stocking inquiry are used to evaluate and respond to that request and support related services.
Submitting material through a private inquiry form does not, by itself, authorize us to publish it in advertising or on social media. We obtain any separate permission needed for a materially different use.

Saved forms

Where a form offers “Save and Continue Later,” information you save is retained so you can resume the request.

Third-party content and links

Our website includes links to other websites and third-party content, including customer ratings and reviews.

When third-party content loads, its provider may receive information such as your IP address, browser information, and the page on which the content appears. Optional technologies associated with that content are subject to the controls described above.

Reviews displayed from a public third-party platform may include names, profile images, and other information made available with those reviews.

Other websites and platforms maintain their own privacy practices. Review their notices when you interact with them.

11. How long we retain information

We retain personal information only for as long as reasonably necessary for the purposes described in this policy, including applicable legal, accounting, warranty, security, and dispute-resolution needs.

Retention depends on the information and our relationship with you.

Orders, invoices, and payment records: Retained for as long as needed to fulfill orders, process returns, and meet accounting, tax, warranty, and legal recordkeeping obligations.

Customer accounts: Maintained for an active customer relationship, then subject to the applicable inactivity or deletion process.

Service inquiries, pond records, and photos: Retained as long as needed to evaluate requests, provide services, conduct reasonable follow-up, and maintain necessary service history or legal records.

Saved forms and abandoned or unsuccessful orders: Security logs, analytics information, and consent records.

Marketing preferences: For marketing purposes, we retain limited suppression records as necessary to honor opt-outs.

Backups: When information is no longer needed, we delete it or de-identify it as appropriate. Certain records may be retained longer where required or permitted by law.

12. Information security

We use administrative, technical, and organizational safeguards appropriate to the information we process.

No website, transmission method, or storage system can be guaranteed completely secure. Use a strong, unique account password and avoid sending sensitive credentials through ordinary email or contact forms.

13. Your privacy choices and rights

Depending on your location, the laws that apply to our business, and the information involved, you may have rights to request access to personal information, obtain a copy, correct inaccuracies, request deletion, withdraw consent, or object to or restrict certain processing.

You may also have rights concerning the sale or sharing of personal information, targeted advertising, certain uses of sensitive information, or qualifying automated decisions. These rights are subject to applicable conditions and exceptions.

To submit a privacy request, contact us using the details below and describe the request. Please use the subject line “Privacy Request” when contacting us by email.

We may need to verify your identity before releasing, correcting, or deleting personal information. We request only information reasonably needed for that purpose. Where applicable law permits an authorized agent to act for you, we may request proof of authorization.

We do not require you to create a new account to submit a privacy request. Cookie choices and applicable browser-based opt-outs can be exercised through the controls described in this policy.

We respond within the time required by applicable law. When we cannot fulfill a request, we explain the reason where required. We do not unlawfully discriminate against you for exercising your privacy rights.

Appeals and complaints

Where an appeal right applies, you can ask us to reconsider a denied request by contacting us with the subject line “Privacy Appeal.” Include the original request and the reason you believe our decision should be reconsidered.

We provide our determination within the applicable legal period and, where required, information about contacting the appropriate regulator or attorney general.

14. Children’s privacy

Our website and online store are intended for a general audience and are not directed to children under 13.

We do not knowingly collect personal information online from children under 13 without any authorization required by law. A parent or guardian who believes a child has provided personal information should contact us so we can review the matter and take appropriate action.
